Environmental Risk Report Disclaimer — please read this document carefully before using any report generated by SiteScreen.

1. Nature of Reports

SiteScreen reports are automated pre-screening tools designed to help commercial real estate professionals triage environmental risk. Reports are generated using automated queries of publicly available government databases and proprietary scoring algorithms. Reports are informational only and do not constitute professional opinions or advice.

2. Not a Phase I ESA

SiteScreen Reports Are NOT Phase I Environmental Site Assessments

  • SiteScreen reports are NOT Phase I Environmental Site Assessments as defined by ASTM E1527-21.
  • Reports do NOT constitute All Appropriate Inquiries (AAI) under 42 U.S.C. § 9601(35)(B) and 40 C.F.R. Part 312.
  • Reports do NOT provide CERCLA liability protections, including:
    • Innocent Landowner Defense
    • Contiguous Property Owner Defense
    • Bona Fide Prospective Purchaser Defense
  • A SiteScreen report cannot and should not be used as a substitute for a Phase I ESA conducted by a qualified Environmental Professional.

3. Data Limitations

Reports are generated using publicly available data from EPA databases (CERCLIS/SEMS, RCRA, NPL, ERNS, FRS, and others) and FEMA flood maps. This data may be:

5. No Professional Advice

SiteScreen does not provide:

Users should engage qualified Environmental Professionals, attorneys, and consultants for property-specific guidance.

6. Risk Score Limitations

  • A LOW risk score does NOT mean a property is free of environmental contamination.
  • A HIGH risk score does NOT definitively confirm contamination exists.

The scoring algorithm is proprietary and based solely on available data in queried government databases. Risk scores should be used as one factor among many in environmental due diligence.

7. No Reliance

No person or entity should rely on a SiteScreen report as the sole basis for any real estate transaction, lending decision, or investment decision. SiteScreen reports are one tool among many that should be used in a comprehensive environmental due diligence process.

8. User Responsibility

The user assumes all responsibility for decisions made based on report content. SiteScreen is not responsible for any losses, damages, failed transactions, regulatory penalties, remediation costs, or other consequences arising from use of or reliance on reports.

9. Recommended Next Steps

For all commercial real estate transactions involving environmental risk considerations, we recommend obtaining a Phase I ESA conducted by a qualified Environmental Professional as defined by ASTM E1527-21.
